Abstract

The Dependence of the Contemporary Japanese Family on the Traditional Ideal Type. – Japanese family legal model incorporated foreign legal prescriptions fifty years ago. Still, the traditional family institutions (patrilinearity, primogeniture, adoption of adults, choosing of marriage partner) remained the pillar of family structure. This is why, as we will endeavour to show, the prescription of the American legal system in the year 1947 was diametrically opposed to the traditional model supported by the Confuscian theory of social harmony.
